Privacy Policy

WooSender Inc. (referred to as “WooSender,” “Company,” “we,” or “us”) recognizes that your privacy is important.

This Privacy Policy (“Policy”) describes how we collect, use, disclose, and protect information in connection with:

  • Our website(s) that link to this Policy (the “Site”); and
  • Our related products and services, including our software platform that our business customers use to engage with their leads and customers (the “Services”).

This Policy also explains how personal and other information that we receive or collect about you and your contacts or end users (“Clients,” “Contacts,” or “End Users”) is treated. Please read the information below to learn more about how we handle your information.

By using the Site and/or Services, you acknowledge that you have read and understand this Policy.

We reserve the right to change this Privacy Policy from time to time. We will notify you about significant changes by:

  • Sending a notice to the primary email address specified in your account,
  • Placing a prominent notice on our Site, and
  • Updating the “Last Updated” date at the top of this page.

Your continued use of the Site and/or Services after such modifications will constitute: (a) your acknowledgment of the modified Policy; and (b) your agreement to abide by and be bound by the updated Policy.

IMPORTANT: BY USING THE SITE AND/OR SERVICES, YOU CONSENT TO THE COLLECTION, USE, AND PROCESSING OF YOUR PERSONAL DATA IN THE MANNER AND FOR THE PURPOSES DESCRIBED IN THIS POLICY. IF YOU DO NOT AGREE TO THIS POLICY, DO NOT USE THE SITE OR SERVICES.


1. Types of Information We Collect

To provide and improve our Services, we collect two broad categories of information: Personally Identifiable Information (“PII” or “personal information”) and Aggregate/Technical Information.

1.1 Personally Identifiable Information (PII)

This is information that identifies, relates to, describes, or could reasonably be linked with a particular individual.

Examples include (depending on how you use the Site and Services):

Account & Contact Information

  • First and last name
  • Email address
  • Mailing address (including postal/zip code)
  • Telephone number(s)
  • Employer, job title, department

Account Credentials

  • Username / login ID
  • Password (stored in encrypted form)

Billing & Payment Information

  • Billing address
  • Limited payment details (e.g., last 4 digits of card, transaction IDs)
  • Note: Full credit card details are typically processed and stored by our third-party payment processor(s), not WooSender directly.

Business & Campaign Information

  • Information about your business, vertical, and marketing preferences
  • Content of campaigns, scripts, templates, and responses you configure in the Services

Communications Data (Platform Usage)

In connection with your use of the Services, we may process:

  • Phone numbers, email addresses, and other contact details of your End Users
  • Call and message metadata (e.g., to/from numbers, email headers, timestamps, duration, delivery status, routing information)
  • Call recordings and/or voicemail (if you enable these features)
  • Content of SMS, email, and other messages transmitted through or stored in the Services
  • Opt-in / opt-out and do-not-contact preferences related to your campaigns

1.2 Aggregate and Technical Information

This is information that does not by itself identify a specific individual. We collect technical and usage information such as:

  • The URL of the website that referred you to our Site
  • The pages you view and the links you click on our Site
  • The URL you go to after visiting our Site
  • Browser type, device type, operating system
  • Internet Protocol (“IP”) address
  • General location information derived from your IP (e.g., city/region)
  • Aggregate usage metrics for the Services (e.g., volume of messages, performance stats)

We may compile and analyze this information on both an individual and aggregated basis to understand and improve how our Site and Services are used.


2. How We Collect and Use Information

2.1 How We Collect Information

WooSender does not collect PII about you unless you voluntarily provide it or it is provided to us by our business customers in the course of using the Services. You may be required to provide certain PII when you elect to use certain products or Services. For example, when you:

  • Register for an account on our Site
  • Configure your company profile and campaigns
  • Upload or sync contact lists, leads, or customer data from third-party systems (e.g., CRM, billing, or practice management tools)
  • Upload user-generated content or other information to the Services
  • Send us an email or support request
  • Submit a form or contact us by phone or letter
  • Provide payment information when ordering products or Services

We may also receive information about you or your End Users from third-party sources (for example, if you integrate WooSender with a CRM, ads platform, or other business system).

2.2 How We Use the Information We Collect

We may use PII and other information for the following purposes:

Providing and Operating the Services

  • Creating and managing your account
  • Authenticating you when you log in
  • Delivering calls, text messages, emails, and other communications you initiate through the Services
  • Processing payments and managing subscriptions
  • Providing customer support and responding to inquiries

Configuring and Managing Campaigns on Your Behalf

  • Storing your scripts, templates, and automation logic
  • Managing contact lists and opt-in / opt-out preferences for your leads and customers
  • Routing communications based on your configuration and instructions

Improving and Developing Our Products

  • Analyzing how the Site and Services are used
  • Testing features, improving performance, and developing new functionalities
  • Creating aggregated and de-identified analytics

Security, Fraud Prevention, and Compliance

  • Detecting, preventing, and investigating security incidents, abuse, unauthorized access, and fraudulent or unlawful activity
  • Enforcing our Terms of Service, acceptable use policies, and other agreements
  • Complying with legal obligations and responding to lawful requests

Marketing and Communications

  • Sending you information about new features, products, and promotions (where permitted by law and your preferences)
  • Providing service-related announcements (e.g., security notices, changes to terms, system updates)

You can opt out of most marketing communications as described in Section 6. We will not use End User personal data for our own independent marketing to those End Users unless we have obtained appropriate consent or are otherwise permitted by law.

Dispute Resolution and Enforcement

  • Resolving disputes, troubleshooting problems
  • Enforcing our contracts, including our Terms of Service and this Policy
  • Protecting our rights, property, and the safety of us, our customers, and others

3. Cookies and Similar Technologies

We use cookies and similar technologies to operate and customize the Site and certain aspects of the Services.

A cookie is a small data file stored on your device that allows us to recognize your browser and remember certain information.

We may use cookies to:

  • Monitor aggregate site usage metrics
  • Remember your login information (if you allow us to do so)
  • Remember your account and interface preferences
  • Personalize portions of the Services and Site
  • Support analytics and performance monitoring

We do not use cookies to track your browsing behavior across third-party sites for behavioral advertising.

Most browsers are initially set to accept cookies, but you can usually modify your browser settings to refuse cookies or to alert you when cookies are being placed on your device. If you disable cookies, some features of the Site or Services may not function properly.


4. Release and Sharing of Information

WooSender does not sell, trade, or rent your PII to third parties.

We may share information in the following limited ways:

4.1 Service Providers and Sub-Processors

We may share PII with trusted third parties who perform services on our behalf, such as:

  • Hosting and infrastructure providers
  • Telecommunication carriers and messaging providers
  • Email service and delivery providers
  • Payment processors and billing platforms
  • Customer support tools
  • Analytics and monitoring tools
  • Professional advisors (e.g., lawyers, accountants)

These service providers are authorized to use PII only as necessary to provide services to us and are bound by contractual obligations to protect PII and process it only according to our instructions.

4.2 To Our Business Customers (Controllers)

If you are an End User or contact of one of our business customers, we may process your personal information on behalf of that customer. In that context:

  • Our customer is the “controller” of your personal data, and
  • WooSender acts as a “processor” or “service provider.”

We may share information about End Users (e.g., communication logs, opt-out events, campaign performance) with the relevant customer in order to deliver and support the Services.

4.3 Legal Requirements and Protection of Rights

We may disclose PII if required to do so by law or in the good faith belief that such action is necessary to:

  • Comply with a legal obligation, court order, subpoena, or other legal process
  • Cooperate with law enforcement or governmental authorities
  • Protect and defend the rights, property, or safety of WooSender, our customers, or others
  • Investigate and prevent potential violations of our Terms of Service, fraud, or security issues

4.4 Business Transfers

If WooSender is involved in a merger, acquisition, financing, reorganization, sale of assets, or similar transaction, PII may be transferred as part of that transaction. We will take reasonable steps to ensure that any recipient of PII honors this Policy or provides similar protections.


5. Updating and Correcting Information

If you have an account with us, you may access and update certain PII at any time by logging into your account and editing your profile and settings, in accordance with instructions on the Site.

You may request that information on your account be deleted or removed; however:

  • We may retain certain information as required or permitted by law,
  • We may retain records of past transactions, logs, and support interactions, and
  • Residual copies of your information may remain in backup systems for a limited period, consistent with our internal data retention policies.

6. Your Choices Regarding Collection and Use

6.1 Marketing Communications

We may send you emails, text messages, or phone calls about products and services that we believe may interest you. If, during registration or in your account, you indicate that you wish to receive offers or information from us and our partners, we may occasionally contact you about such products and services.

You can opt out of marketing communications by:

  • Following the “unsubscribe” or “stop” instructions in the communication;
  • Replying to SMS messages with “STOP”;
  • Updating your preferences in your account settings, where available.

Please note that even if you opt out of marketing communications, we may still send you service-related communications (e.g., security alerts, legal notices, transactional messages about your account).

6.2 Cookies and Tracking

As described in Section 3, you can control cookies through your browser settings. If you choose to reject cookies, some Site or Service features may not function properly.


7. Security of Your PII

We take reasonable and appropriate technical and organizational measures to protect PII from unauthorized access, use, alteration, or disclosure. These measures include, for example:

  • Encryption of PII in transit (e.g., HTTPS/TLS) and, where appropriate, at rest
  • Logical access controls and role-based access to systems and data
  • Firewalls and network security measures
  • Secure hosting environments and data center protections
  • Password hashing and authentication controls
  • Internal policies and staff training on data protection and security

We limit access to PII to employees, contractors, and agents who have a legitimate business need to access such information and who are bound by confidentiality obligations.

Despite our efforts, no method of transmission over the Internet or method of electronic storage is 100% secure. You acknowledge that:

  • There are inherent security and privacy limitations of the Internet that are beyond our control; and
  • We cannot guarantee absolute security of your information.

If we become aware of a data breach affecting PII, we will comply with applicable breach notification laws, which may include notifying you and/or the relevant customer and regulators.

You agree to promptly notify us if you become aware of any unauthorized access to or use of your account or device that may affect the security of the Site or Services.


8. Miscellaneous

You must be at least 18 years old to use the Site and Services. By using the Site or Services, you represent and warrant that you are at least 18 years of age. We do not knowingly collect, use, or disclose PII from children under 18.

9. GDPR / UK GDPR: European or UK Data Subjects

Our customers may use WooSender to collect and process personal data of individuals located in the European Union (“EU”) or United Kingdom (“UK”) in connection with their marketing, sales, or customer engagement activities.

For the purposes of the EU General Data Protection Regulation (“GDPR”) and the UK GDPR:

  • Our customer is typically the data controller of End Users’ personal data; and
  • WooSender acts as a data processor (or “processor”) on behalf of that customer.

We process such personal data solely in accordance with our customer’s documented instructions and our contractual obligations as a processor, including any data processing agreement (“DPA”) in place with that customer.

If you are an End User whose data is processed through WooSender by one of our customers, please direct your data protection requests (e.g., access, deletion, objection) to that customer (the controller), as we generally cannot respond directly to such requests without their instructions.


10. Legal Basis (for EU / EEA / UK Users

In some jurisdictions (such as the EU/EEA and UK), we must identify the legal basis on which we process personal data. Depending on the context, we rely on one or more of the following legal bases:

Performance of a Contract

Where processing is necessary to perform our contract with you (e.g., to provide the Services, manage your account, process payments, provide customer support).

Compliance with Legal Obligations

Where we are required to process personal data to comply with applicable laws (e.g., tax, accounting, regulatory obligations, or lawful requests from authorities).

Legitimate Interests

Where processing is necessary for our legitimate interests or those of a third party, and these interests are not overridden by your rights and freedoms. Examples include:

  • Securing and improving our Site and Services
  • Fraud detection and prevention
  • Network and information security
  • Internal analytics and product development
  • Certain direct marketing to existing customers (where permitted by law)

Consent

Where required by law (e.g., certain marketing activities, some types of cookies, or processing of sensitive data), we will obtain your consent and allow you to withdraw it at any time.

  • If you are an End User of one of our customers, please contact the relevant customer (the controller). Where appropriate and authorized, we will assist our customer in responding to your request.

If you are located in the EU/EEA, UK, or other jurisdictions with data protection authorities, you may also have the right to lodge a complaint with a supervisory authority.
